These Terms and Conditions apply to all purchases
made by you, the customer, from us, Ponderosa Bird & Pet Centre.
1. CUSTOMER SERVICE
We are committed to total customer care and abide
by the principles of The Consumer Protection (Distance Selling) Regulations
2000. Should you wish to speak to our customer services department please
telephone 01452 713229, Monday to Friday between 9.00 am and 5.00 pm.
2. DELIVERY
We aim to despatch our products within 48 hours of
accepting your order. Products that are despatched by our nominated carrier
will require a valid signature as proof of delivery (POD). Not all our
products will require a proof of delivery signature and our customer service
team will be happy to advise.
Delivery dates are not guaranteed, but we will make
every reasonable effort to ensure that goods are delivered within 28 days of
being ordered. We only deliver to GB mainland addresses; this excludes Isle
of Wight, Anglesey and Northern Ireland. We do not deliver to BFPO
addresses, Scilly Isles, Western or Northern Isles, Isle of Man or the
Channel Islands. In some circumstances, it may be possible to deliver to the
Isles, but we cannot guarantee this. Please contact us for advice.
3. AVAILABILITY
All orders are accepted subject to stock
availability. Where you have ordered several products and not all are in
stock, we may send you the products which are available; we will send the
remainder of your order as soon as the stock becomes available. If the goods
ordered are out of stock, we will contact you within 30 days from the day
after your order was placed. If the goods are coming back into stock, we
will propose a new delivery date or, with your agreement, we may be able to
supply you with substitute goods. If we have received payment from you for
goods out of stock, or you do not wish to wait for goods to become
available, and/or decline our offer of substitute goods, we will refund any
monies due, within 7 days of receiving your instructions.
4. VAT
Prices on our website all include VAT at the
appropriate rate.
5. WAYS TO PAY
To place an order use the link to our online
shop at the top left of this page, or call us on 01452 713229, we are
open 7 days a week, from 9.00 am to 5.00pm. Our staff will be happy to take
your order. If you wish to place an order please have your credit or
debit card to hand. We accept Switch, MasterCard, Delta and Visa.
Ponderosa Bird & Pet Centre customers must be
18 years of age or over. You will be asked to provide your personal details.
It is your responsibility to ensure that the details provided by you for the
purpose of ordering products from us are correct and that you have the
necessary credit limits and/or authority to use the credit or debit card you
present to us.
6. RIGHT TO CANCEL
You have a right to cancel your order within 7 days
of the goods being delivered to you. Please call 01452 713229 should you
change your mind.
7. CANCELLATION & RETURNS
Provided the goods are returned in good condition,
in the original packaging and not used we will issue a refund (excluding
postage) within 7 days. Should you wish to return a product to us, send it
to Ponderosa Bird & Pet Centre, Dundry Nurseries, Bamfurlong Lane,
Cheltenham, Gloucestershire GL51 6SL. You should include a letter stating
the reasons for return when sending your parcel back to us. Should you need

If you are cancelling because there is a fault with
the product, clearly state details of the fault. We will meet the cost of
returning the product or products to us if the goods are faulty or incorrect
by issuing you with a postal order or cheque. For all other cancellations,
you must return the goods to us at your cost.
Please contact us prior to returning a product as
we may be able to supply a solution over the telephone. PRODUCTS RETURNED AS
FAULTY BUT FOUND TO BE WORKING OR DAMAGED BY MISUSE WILL INCUR AN ADDITIONAL
CARRIAGE CHARGE TO RETURN THE PRODUCT TO YOU.
8. STATUTORY RIGHTS
To obtain a refund, you must return the goods to us
in the same condition as they arrived. So that there is no doubt, anything
we say above in relation to returns, does not apply to any claim that the
goods do not meet a standard required by law. Therefore if the goods are
faulty or were damaged in transit, we will cover the postage costs.
9. LIABILITY
If you have notified us of a problem with the
goods, we will either make good any shortage or non-delivery, replace or
repair any goods that are damaged or defective upon delivery, or refund you
with the amount paid for the goods. This does not affect your statutory
rights as a consumer, nor is it intended to limit our liability to you for
fraudulent misrepresentation or for death or personal injury resulting from
our negligence.
10. SAFETY ADVICE
For your own safety we recommend that you read
carefully all safety information printed either on the packaging, or in any
leaflets that may be included with the product. For electrical products
always check the power cable and plug for any signs of damage. Always
consult a qualified electrician and never attempt to repair any product
yourself.
11. ERRORS
Every effort has been made to ensure that the
information supplied is correct at the time of going to press.
By purchasing products from us, you agree to these
terms of sale. Ponderosa Bird & Pet Centre have the right to revise
these terms and conditions including prices at any time. We also have the
right to decline service to any individual customer.
